Property Law and Contracts

Evaluate the law and contract provisions that impact and secure property value with respect to property rights and obligations, public private partnerships, conveyance, ownership structure, leases, liens, mortgages, property finance, rights of way, easements, covenants, and other legal and contract provisions.

Throughout the semester in FINC 676- Commercial Real Estate Law, we were taught how to read and interpret various legal ownership interests, choice of entity, sales and closings, and lease, note, and deed of trust analysis, among other topics as well as how to structure specific real estate deals and negotiate contracts. It's important to understand the vocabulary that goes into these deals as it could be a deciding factor in how the contract benefits or negatively impacts your business. Property Law refers to both real property and personal property and the rules regarding the property whereas contract law is an agreement between two or more parties on and agreed price and terms set forth in the agreements.

In FINC 676 one of our projects was to act as the buyer in a negotiation for a Class “B” 85 unit apartment complex. Given the provided facts, we laid out terms for our preferred offer and the contract was negotiated and agreed upon by both the Buyer and Seller
